Peter A. Devlin is an attorney in the firm’s Litigation and Data Strategy, Privacy & Security Groups.
Recognized by National Law Journal as a “Litigation Trailblazer,” he is a strategic and creative advocate who represents companies and individuals in high-stakes privacy, commercial, consumer protection, and intellectual property matters.
Focused on class action and regulatory defense, he has significant experience with disputes involving privacy, unfair and deceptive acts and practices (UDAP), false advertising laws, and emerging theories around video game design, AI, and internet tracking technologies. He has had notable success challenging new regulations of digital platforms. His successes have been featured in The American Lawyer’s “Litigator of the Week.”
Mr. Devlin regularly handles complex commercial disputes in both trial and appellate proceedings involving contracts, fiduciary duties, copyright, trademark, unfair competition, and fraud. In addition to litigation, he counsels companies on product risks and updating terms of service to address consumer protection and arbitration issues.
His representative matters include:
- Represented mobile gaming company in investigation by California Privacy Protection Agency (CPPA) alleging violations of CCPA/CPRA.
- Secured favorable early settlement for children’s app publisher in consumer class action alleging dark patterns and deceptive design.
- Obtained preliminary injunction for food delivery app platform challenging new City of New York minimum pay regulations.*
- Negotiated pre-suit resolution of class action claims for e-commerce site involving “strike through” pricing advertising practices.
- Represented Facebook in state attorney general enforcement action alleging state law privacy violations connected to Cambridge Analytica.*
- Obtained preliminary injunction against internet company for breach of contract and unauthorized use of international sports organization’s trademarks.
- Successfully compelled arbitration in securities class action against NFT company.*
- Advised global media company on generative AI, scraping, and copyright issues.*
- Secured summary judgment for national telecommunications company on breach of contract claims against licensee of cable infrastructure.*
- Represented electrical wire manufacturer in false advertising and antitrust claims against industry incumbents and defended against fraud counterclaims.
- Represented former employees of cryptocurrency exchange in New York Department of Financial Services (DFS) fraud investigation.*
Mr. Devlin clerked for the Honorable Dennis Jacobs of the United States Court of Appeals for the Second Circuit and the Honorable Valerie Caproni of the United States District Court for the Southern District of New York. Prior to joining Frankfurt Kurnit, Mr. Devlin practiced at a leading litigation boutique and the litigation department of a global law firm.
Mr. Devlin graduated cum laude from New York University School of Law, where he was a Florence Allen Scholar and Managing Editor of the N.Y.U. Law Review. Before law school, he worked as a technology consultant helping to design and implement state health insurance exchanges under the Affordable Care Act.
Mr. Devlin is a Certified Information Privacy Professional (CIPP/US). He is admitted to practice in New York and the United States District Court for the Southern and Eastern Districts of New York and the United States Court of Appeals for the Second Circuit.
