Matthew R.D. Vittone
Matthew R.D. Vittone is counsel to the Advertising, Marketing & Public Relations Group representing agencies, brands, and media companies in connection with advertising, branded entertainment, intellectual property, and digital media matters.
He is recognized by Chambers USA (2025) as an “Up and Coming” attorney in Advertising (Transactional & Regulatory), and by Best Lawyers in America (2021-2026) in the “Ones to Watch” category for Intellectual Property. The Legal 500 lists him as a “Key Lawyer” for 2023-2025.
Mr. Vittone is adept at structuring and negotiating the full spectrum of advertising industry transactions. He works with clients on creative services and media agreements, agency-client agreements, talent, endorsement and influencer agreements, sponsorship agreements, branded entertainment agreements, production agreements, and music and other content licenses and releases. He also counsels clients on advertising and marketing issues (including copy and content review, claim substantiation, social media guidelines, and regulatory compliance) and intellectual property law matters (including copyright, trademark and right of publicity). Mr. Vittone has developed particular expertise in AI and other emerging technologies.
Mr. Vittone is a frequent speaker at major legal and industry conferences. Recent speaking engagements include presentations for the Institute for Real Growth (IRG) Cannes Summit at the Cannes Lions International Festival of Creativity 2025, the Society of Digital Agencies (SoDA), the Association of National Advertisers (ANA), Columbia Law School, the Federal Bar Association, and the New York City Bar Association. Recent topics include “Humanized Growth in the Era of AI”; “AI Frontiers in Digital Advertising and AdTech”; “Digital Advertising and Marketing Agreements: Tackling Key Issues, Mitigating Legal Risks”; “Key Issues in Agency-Advertiser Agreements”; “Generative AI Use in Film and Video”; “Influencer Marketing” and “Hot Topics in Advertising and Marketing Law”. Additionally, he authored Chambers’ “Trends and Developments” article for their “Advertising & Marketing 2024 Law and Practice” guide for the USA.
Prior to joining Frankfurt Kurnit, Mr. Vittone was an attorney in the corporate group at Paul, Weiss, where he represented companies in entertainment and other industries in mergers, acquisitions, corporate reorganizations and other complex transactions.
As a student at Harvard Law School, he assisted the litigation team representing artist Shepard Fairey in presenting a “fair use” defense to copyright infringement claims regarding the iconic Barack Obama “HOPE” image. He also worked for MTV Networks, Home Box Office (HBO), video game developer Harmonix, and music law firm Carroll, Guido & Groffman. He was awarded a Cravath International Fellowship for clinical work at the Arts Law Centre of Australia, a non-profit organization providing legal advice and resources to Australian artists and arts organizations.
He is admitted to practice in New York.
