The article shares a brief summary of the Supreme Court’s decision in B&B Hardware, Inc. v. Hargis Industries, Inc., 573 U.S. 957 (2015), and discusses whether courts have applied B&B Hardware to preclude relitigation of the issue of likelihood of confusion, and not whether courts view B&B Hardware as precluding a claim for trademark infringement.
