Kimberly M. Maynard is Co-Chair of the Trademark & Brand Management Group and Co-Chair of the Litigation Group.
The World Trademark Review named her one of the “World’s Leading Trademark Professionals,” noting that “she is smart, practical and comprehensive” and “provides top-flight trademark advice.”
In her trademark practice, Ms. Maynard works with clients to manage their global and domestic trademark portfolios and to establish cost-effective, results-oriented trademark enforcement programs. Her clients range from established brands with trademark portfolios that span the globe to newer companies in the process of developing intelligent trademark strategies. Ms. Maynard counsels clients on clearing and registering new trademarks, advises them on trademark enforcement and defense, and helps her clients navigate issues concerning trademarks and the internet.
Ms. Maynard is also a sought-after intellectual property and false advertising litigator with considerable experience representing emerging and established companies in all manner of trademark, trade dress, and false advertising disputes before the federal courts and the Trademark Trial and Appeal Board. She uses her sophisticated understanding of the trademark and false advertising laws and creative problem-solving to secure critical victories that protect her client’s most valuable assets—their intellectual property—both in the U.S. and abroad. Ms. Maynard’s representative matters include:
- Obtaining a temporary restraining order and preliminary injunction for the International Olympic Committee during the Olympic Games;
- Defending Northwell Health against false advertising, trademark and trade dress claims, including securing an early dismissal of certain claims;
- Swiftly defeating a motion for expedited relief against a major beverage company accused of being a holdover licensee;
- Earning a decisive victory for JetBlue at the Trademark Trial and Appeal Board, including securing a ruling that the JETBLUE mark is famous;
- Representing Sprint in a high profile false advertising suit against AT&T;
- Leading teams of lawyers in seven countries in an international trademark dispute on behalf of Polygon, a blockchain developer, and ultimately winning an early and favorable settlement.
Ms. Maynard is widely recognized as a thought leader on trademark and false advertising issues. She has been named a leading trademark professional by The World Trademark Review and The World Intellectual Property Review and has been included in both Super Lawyers for the New York Metro Area and the Super Lawyers list of the “New York Metro Area’s Top Women.” The Legal 500 has recognized her Advertising and Marketing Litigation expertise. Ms. Maynard has spoken at events sponsored by the Intellectual Property Owners Association, Managing IP, the Corporate IP Institute, the World IP Review, the Practical Law Institute, among others. She also has published articles in and been quoted by numerous publications, including Law360, IP Litigator, Bloomberg Law, and The Post and Courier.
Ms. Maynard is a member of the Intellectual Property Owners Association’s U.S. Trademark Law Committee and has long served on committees for the International Trademark Association. She previously served as an Adjunct Professor at New York Law School, where she founded the law school’s PTO Trademark Clinic, and was the founding Chair ofthe firm’s Pro Bono Committee.
