Daniel M. Goldberg is Chair of the Data Strategy, Privacy & Security Group.
The California Lawyers Association named him the 2025 California Privacy Lawyer of the Year for his leadership and impact on the field. He is the third recipient and the first private practitioner to receive the honor.
Daniel helps clients turn data risk into business advantage. He advises on all aspects of data use, including privacy, security, AI, and monetization, across industries and regulatory frameworks. Bridging law, technology, and business strategy, he helps organizations operationalize compliance, build trust, and innovate responsibly.
Privacy, Security & AI Compliance
Daniel counsels clients on compliance with federal law, state privacy statutes, sectoral rules, and industry standards. He works with legal, product, and engineering teams to map data flows, assess risk, and design global governance programs. His work often involves sensitive datasets such as precise location, health, and children’s data, as well as compliance with platform privacy and technical requirements, including those imposed by Apple and other major ecosystems. He also advises on emerging AI regulations and risks involving algorithmic accountability, training data, chatbots, agentic AI, and automated decision-making.
Enforcement & Regulatory Insight
Daniel represents clients in regulatory inquiries and settlement negotiations, including some of the first public CCPA actions. He brings a practical understanding of how regulators interpret and enforce data laws, helping clients anticipate risk, resolve investigations efficiently, and strengthen compliance programs before issues arise.
Data Strategy, Monetization & Technology Transactions
Daniel helps clients responsibly and lawfully unlock the value of their data. He negotiates data licensing, API, clean room, and identity resolution agreements; advises on ad-tech integrations, measurement, and de-identification standards; and structures data access and training arrangements for large language models (LLMs), agentic AI systems, and other machine-learning technologies. His transactional work includes SaaS, enterprise AI, data processing, and data transfer agreements that align commercial goals with evolving privacy and AI standards.

Mr. Goldberg stated that the area of privacy regulation has been exploding with growth, with California on the forefront —driving a need for designating leaders in the field. “‘The law is very complex. But on top of the law being complex, the specialization really requires a level of technical expertise. The law talks all about measures that companies need to take with respect to collection, use, disclosure of data and opting out. But if you don’t understand how the technology works or how the ecosystem works, then it’s an area that would be very, very difficult for you,’ he said.”
“He added, ‘One thing about privacy law is that you also have to be an expert on what’s going on in the news, the latest changes and whether it has to do with ad-tech platforms or AI. If you’re not up with the latest changes, you’re going to fall behind very quickly.’”
Mr. Goldberg emphasized California's pioneering role in privacy regulation. He referenced the state’s passing “the first comprehensive privacy law (the California Privacy Act or CCPA) in 2018, which he said catalyzed the creation of similar laws across other states and established California as the national leader in privacy legislation.” He noted the state had also been a leader in enforcement, citing activity of the Attorney General’s office and the California Privacy Protection Agency’s multiple enforcement actions.
Mr. Goldberg also explained why data privacy is an increasing legal practice at law firms: “‘It’s incredibly lucrative just because it’s such a broad area. It really is a subject matter expertise that goes in so many different subcategories of practices, and so almost every firm now has to have a privacy expert.'" View Article

A Federal Judge Ordered OpenAI to Stop Deleting Data

Daniel M. Goldberg is quoted in an Adweek article, which reported that a federal judge has ordered OpenAI to stop deleting output data from ChatGPT. This was part of The New York Times lawsuit, alleging OpenAI engaged in copyright infringement “by using ‘millions’ of articles published by the newspaper to train its AI model, which now directly competes with the Times’ content as a result.” The judge’s order seeks to preserve evidence in the Times’ case. Mr. Goldberg addressed mulitple implications of the order, which requires OpenAI to hold more data than they normally would. "That could make OpenAI more susceptible to security breaches, or shake the trust of consumers who expected their chatbot records to be deleted. There are also potential implications regarding energy use, storage and environmental impact that the judge may not have considered when making the order, Goldberg said." He also noted the order would trigger people's concerns about what it means for working with large tecnology providers.
